These terms govern your use of talk1min (“talk1min”, “we”, “us”). Please read them carefully, in particular the sections on AI-generated feedback, warranties and liability.
By creating an account, ticking the box to accept these terms, or otherwise using talk1min, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use talk1min.
talk1min is a daily English-speaking practice tool: you record up to 60 seconds answering a prompt, and we email you AI-generated scores, a transcript and written feedback. It is a practice aid only: not a language test, a certified assessment, or a substitute for a teacher.
You keep ownership of everything you record or type. You grant us a limited, non-exclusive, worldwide licence to process it (including by sending it to third-party service providers) solely to generate and deliver your results and to operate and secure talk1min, as described in the Privacy Policy.
You are responsible for what you submit. Only record your own voice, or voices you have permission to record, and do not submit anything unlawful or that infringes anyone's rights.
You agree not to:
All scores, transcripts and feedback are generated automatically by artificial-intelligence systems. They may be inaccurate, incomplete or inconsistent; for example, a transcript can contain mistakes, and the same recording may score slightly differently on different occasions. They are provided for general practice and educational purposes only.
Nothing talk1min produces is professional, educational, immigration, employment or any other kind of advice, a certified assessment, or a prediction of your result in any exam (such as IELTS or TOEFL). Do not rely on it as the basis for any decision, including study, exam, admission, visa, hiring or financial decisions. We are not responsible for any decision you make, or any loss you suffer, from relying on it. If something matters, check it with a qualified teacher or examiner.
talk1min relies on third-party services (for example for sign-in, hosting, email delivery and AI processing). They are outside our control, may change or fail, and are governed by their own terms. We are not responsible for their acts, omissions or availability.
talk1min is provided free of charge and is still evolving. We may set or change daily limits, and may modify, suspend or discontinue any part of the service at any time, with or without notice. We do not guarantee that the service will be available, uninterrupted, timely or error-free, or that results will be delivered by any particular time.
We may suspend or end your access at any time, including if we believe you have broken these terms or are abusing the service. You may stop using talk1min at any time, and you may ask us to delete your data as described in the Privacy Policy.
talk1min, its software, design, content and branding belong to us or our licensors and are protected by law. These terms give you no rights in them other than the right to use the service as offered, for your own personal, non-commercial practice.
If you send us comments or suggestions (for example through the feedback page linked from our emails), you agree we may use them freely, without obligation or payment to you.
To the fullest extent permitted by law, talk1min is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, and that results will be error-free or will improve your English.
To the fullest extent permitted by law, we (and our owners, contractors and service providers) are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, opportunities or goodwill, arising out of or related to your use of (or inability to use) talk1min, even if we were told such loss was possible.
Our total liability for all claims relating to talk1min is limited to the amount you paid us for it in the 12 months before the claim or, since talk1min is free, USD 10, whichever is greater. Some places do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent the law permits.
You agree to defend and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your content, your misuse of talk1min, or your breach of these terms or of anyone else's rights.
We may update these terms. When we make a material change we will change the “Last updated” date above and may ask you to accept the new version before you continue recording. Continuing to use talk1min after a change means you accept it.
These terms, together with the Privacy Policy, are the whole agreement between you and us about talk1min. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours. Nothing in these terms removes any right you have under mandatory consumer-protection law where you live.
